KANSAS HOMESCHOOL LAW

Compulsory School Age: 7 - 18

Kansas state law offers three legal homeschooling options: 1) operate a homeschool as a non-accredited private school, 2) operate a homeschool as a satellite program of an accredited private school, or 3) qualify for state-approved religious exemption of the high school grades.

  1. The first legal homeschooling option in Kansas is to operate a homeschool as a non-accredited private school. Under this option, the child's parents or guardians must register the school with the Board of Education. The name and address of the school is all that is needed for registration and there is no approval needed from the school board. Attendance must be "substantially equivalent" to that of public schools, which is 186 days (or 1116 academic hours) per year. Teachers must be competent; however, Kansas statute does not define competence, and therefore the state has no authority to evaluate the competence of parents/teachers under this option. No specific subjects are required and there are also no mandates specifying recordkeeping or testing.

  2. The second option is to operate a homeschool as an accredited private school satellite program. Attendance must be "substantially equivalent" to that of public schools, which is 186 days (or 1116 academic hours) per year. Teachers must be competent; however, Kansas statute does not define competence, and therefore the state has no authority to evaluate the competence of parents/teachers under this option. Subjects, recordkeeping, and testing procedures are established by the private school. No requirements regarding school board notification exist.

  3. The third and final option is to qualify for state-approved religious exemption of the high school grades. Policies and requirements regarding attendance, subjects, parent/teacher qualifications, school board notification, recordkeeping and/or reports, and testing are established by the school board at the time of approval.
