YORK HOMESCHOOL LAW
Compulsory
School Age: 6 - 16
New York
state law offers one legal homeschooling option, which is to establish
and operate a homeschool. In order to legally homeschool in New
York an annual notice of intent and an "Individualized Home Instruction
Plan" must be filed with the local school superintendent by July 1 or
within 14 days of starting a homeschool program. Instruction must
be conducted by a "competent person." A parent/teacher is considered
competent if he/she adheres to regulations. Children schooling
under this option are required to attend instruction for the
"substantial equivalent" of 180 days per year. Students in grades
1 - 6 must receive 900 hours of instruction per year and students in
grades 7 - 12 must receive 990 hours of instruction per year.
Students are to be instructed in required subjects as follows:

Grades
1 - 6: math, reading, spelling, writing, English, geography, United
States history, science, health education, music, visual arts,
physical education, and bilingual education and/or English as a
second language as needed

7 - 12: English, history and geography, science, math, physical
education, health education, art, music, practical arts, and library
skills

At
least once during grades 1 - 8: United States history, New York
State history, and the Constitutions of the United States and New
York State

Grades
9 - 12: English, social studies (including American history,
government, and economics), math, science, art and/or music, health
education, and physical education

Grades
K - 12: patriotism and citizenship; health education regarding
alcohol, drug and tobacco misuse; highway safety and traffic
regulations, including bicycle safety; and fire and arson prevention
and safety
New York
does require recordkeeping and testing to be conducted on a regular
basis. Attendance records must be maintained and submitted for
review to the local school superintendent upon request. Quarterly
reports must also be filed with the local school superintendent and must
include the following: number of instructional hours per quarter,
descriptions of subject materials covered, and a grade or written
evaluation for each subject. Annual assessments must be filed with
the last quarterly report to the local school superintendent by June 30
each year. The assessment may be either a non-referenced
achievement test or a written evaluation.
